5. No Guarantee of Results: We make no guarantee that the use of our services will result in any specific outcome or result.
6. Payment and Refund Policy: We require payment in full for all services rendered. If you are not satisfied with our services, please contact us within 30 days of receipt of the final product. We will make every effort to address your concerns and work with you to achieve a satisfactory resolution.
7. Limitation of Liability: Brisuntech shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to the use of our website or services.
8. Indemnification: You agree to indemnify and hold Brisuntech harmless from any claims, damages, or expenses arising out of or related to your use of our website or services.
9. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the State of California.

12. Non-Disclosure Agreement (NDA):
13. As a provider of medical transcription services, Brisuntech is committed to protecting the privacy and confidentiality of our clients. We adhere to the Health Insurance Portability and Accountability Act (HIPAA) regulations and require all of our employees to sign a non-disclosure agreement (NDA) to ensure that they maintain the confidentiality of all client information.
14. By using our services, you agree to abide by the terms of our NDA and to maintain the confidentiality of all client information that you may have access to. You may not disclose, share, or use any client information for any purpose other than for the purposes of providing transcription services to our clients. Any breach of our NDA may result in legal action and/or termination of our services.

Brisuntech shall not be liable for any damages, whether direct, indirect, incidental, or consequential, arising from the use or inability to use the website or its services, including, but not limited to, damages for loss of profits, use, data, or other intangible assets, even if Brisuntech has been advised of the possibility of such damages.
17. The user agrees to indemnify and hold Brisuntech harmless from any claim or demand, including reasonable attorney's fees, made by any third party arising out of the user's use of the website or its services, or the user's violation of these terms and conditions.

19. Non-Disclosure Agreement (NDA)
20. The user acknowledges and agrees that the information provided to Brisuntech for medical transcription services may be confidential and sensitive in nature.
21. Brisuntech agrees to protect the confidentiality of all information provided by the user for medical transcription services, in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and other applicable laws and regulations.
22. Brisuntech agrees not to disclose or use any confidential information provided by the user for any purpose other than the provision of medical transcription services to the user.
23. The user agrees to provide only the minimum necessary information required for Brisuntech to provide medical transcription services.
24. The user acknowledges and agrees that any breach of confidentiality by the user may result in irreparable harm to Brisuntech and may entitle Brisuntech to seek injunctive relief, in addition to any other legal remedies available.
25. This NDA shall remain in effect for as long as the user continues to use the services of Brisuntech for medical transcription, and for a period of five (5) years thereafter.
26. The user acknowledges and agrees that this NDA constitutes the entire agreement between the user and Brisuntech with respect to the confidentiality of information provided for medical transcription services, and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to such confidentiality.
27. This NDA shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns.
28. Any modification to this NDA must be in writing and signed by both parties.
29. By using the website and its services, the user acknowledges that they have read, understood, and agreed to these terms and conditions, as well as the Non-Disclosure Agreement. If the user does not agree to these terms and conditions, they should immediately discontinue their use of the website and its services.
30. Brisuntech reserves the right to modify or update these terms and conditions at any time without prior notice. The user is responsible for regularly reviewing these terms and conditions to stay informed of any changes. The continued use of the website and its services after any such changes shall constitute the user's consent to such changes.
31. Brisuntech reserves the right to modify or discontinue any aspect of the website or its services at any time without prior notice.
32. The user acknowledges and agrees that Brisuntech may use cookies or other tracking technologies to collect information about the user's use of the website and its services.

The user agrees that any disputes arising out of or relating to these terms and conditions, the Non-Disclosure Agreement, or the use of the website and its services shall be resolved through arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
34. These terms and conditions and the Non-Disclosure Agreement shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.
35. The user acknowledges and agrees that any failure by Brisuntech to enforce any provision of these terms and conditions or the Non-Disclosure Agreement shall not be construed as a waiver of any such provision or right.
36. If any provision of these terms and conditions or the Non-Disclosure Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
37. The headings used in these terms and conditions and the Non-Disclosure Agreement are for convenience only and shall not affect the interpretation of these documents.
38. These terms and conditions and the Non-Disclosure Agreement constitute the entire agreement between the user and Brisuntech with respect to the use of the website and its services, and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to such use.
39. The user acknowledges and agrees that any breach of these terms and conditions or the Non-Disclosure Agreement may cause irreparable harm to Brisuntech, for which monetary damages would not be an adequate remedy, and that Brisuntech shall be entitled to seek injunctive relief or other equitable remedies in addition to any other remedies available at law or in equity.
40. The user acknowledges and agrees that any information or materials submitted to Brisuntech through the website or its services, including but not limited to transcription files and patient data, may be subject to the terms of the Non-Disclosure Agreement and the requirements of the Health Insurance Portability and Accountability Act (HIPAA) and its regulations.
41. Brisuntech shall not be liable for any loss or damage arising from the user's use of the website or its services, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
42. The user agrees to indemnify and hold Brisuntech and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the user's use of the website or its services, the user's violation of these terms and conditions or the Non-Disclosure Agreement, or the user's violation of any rights of another.
43. The user acknowledges and agrees that Brisuntech may terminate the user's access to the website or its services at any time and for any reason, without liability to the user or any third party.
44. The user acknowledges and agrees that Brisuntech may, in its sole discretion, assign its rights and obligations under these terms and conditions and the Non-Disclosure Agreement to any third party without notice or consent.
45. The user acknowledges and agrees that any notices or other communications required or permitted under these terms and conditions or the Non-Disclosure Agreement may be provided to the user electronically, and the user consents to receive all such notices and communications in electronic form.
46. The user acknowledges and agrees that the user's electronic acceptance of these terms and conditions and the Non-Disclosure Agreement shall have the same force and effect as a handwritten signature.
47. The user acknowledges and agrees that the user has read these terms and conditions and the Non-Disclosure Agreement, understands them, and agrees to be bound by them.
48. These terms and conditions and the Non-Disclosure Agreement shall be governed by and construed in accordance with the laws of the state where Brisuntech is located, without giving effect to any principles of conflicts of law.
49. Any dispute arising out of or relating to these terms and conditions or the Non-Disclosure Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state where Brisuntech is located, and the arbitration award may be enforced in any court of competent jurisdiction.
50. These terms and conditions and the Non-Disclosure Agreement constitute the entire agreement between the user and Brisuntech with respect to the use of the website and its services, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the user and Brisuntech.
51. If any provision of these terms and conditions or the Non-Disclosure Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
52. The user acknowledges and agrees that the failure of Brisuntech to exercise or enforce any right or provision of these terms and conditions or the Non-Disclosure Agreement shall not constitute a waiver of such right or provision.

The user agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the website or its services, these terms and conditions, or the Non-Disclosure Agreement must be filed within one year after such claim or cause of action arose or be forever barred.
54. The headings used in these terms and conditions and the Non-Disclosure Agreement are for convenience only and shall not affect the interpretation of these terms and conditions or the Non-Disclosure Agreement.
55. The user may not assign these terms and conditions or the Non-Disclosure Agreement, in whole or in part, without the prior written consent of Brisuntech. Any attempt to do so without such consent shall be void and of no effect.
56. Brisuntech may assign these terms and conditions or the Non-Disclosure Agreement, in whole or in part, without notice to the user.
57. These terms and conditions and the Non-Disclosure Agreement are binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors, and assigns.
58. The user acknowledges and agrees that it has read these terms and conditions and the Non-Disclosure Agreement, understands them, and agrees to be bound by their terms and conditions.
59. Brisuntech may amend these terms and conditions or the Non-Disclosure Agreement at any time, and such amendments shall be effective immediately upon posting on the website. The user's continued use of the website or its services after such posting constitutes the user's acceptance of the amended terms and conditions or Non-Disclosure Agreement.
60. The user agrees that any notices or other communications provided by Brisuntech to the user electronically shall satisfy any legal requirement that such communications be in writing.

The user acknowledges and agrees that these terms and conditions and the Non-Disclosure Agreement, together with any other agreements, policies, or guidelines incorporated by reference, constitute the entire agreement between the user and Brisuntech and govern the user's use of the website and its services.
62. The user acknowledges and agrees that the website and its services are provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
63. Brisuntech shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to the use of the website or its services, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

The user agrees to indemnify and hold Brisuntech and its officers, directors, employees, agents, and affiliates harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the user's use of the website or its services, violation of these terms and conditions or the Non-Disclosure Agreement, or infringement of any intellectual property or other right of any person or entity.
65. The user acknowledges and agrees that the provisions of these terms and conditions and the Non-Disclosure Agreement which by their nature are intended to survive termination, shall survive any termination of these terms and conditions or the Non-Disclosure Agreement.

67. In the event of any dispute arising out of or relating to these terms and conditions or the Non-Disclosure Agreement, the user agrees to first attempt to resolve the dispute by contacting Brisuntech's customer service.
68. These terms and conditions and the Non-Disclosure Agreement shall be governed by and construed in accordance with the laws of the State, without giving effect to any principles of conflicts of law.
69. Any legal action or proceeding arising out of or relating to these terms and conditions or the Non-Disclosure Agreement shall be brought exclusively in a federal or state court of competent jurisdiction sitting , and each party hereby submits to the jurisdiction and venue of such courts.
70. The failure of Brisuntech to enforce any right or provision of these terms and conditions or the Non-Disclosure Agreement shall not constitute a waiver of such right or provision.
71. If any provision of these terms and conditions or the Non-Disclosure Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these terms and conditions or the Non-Disclosure Agreement remain in full force and effect.
72. The user may not assign these terms and conditions or the Non-Disclosure Agreement or any of its rights or obligations hereunder, whether by operation of law or otherwise, without the prior written consent of Brisuntech.
73. The Non-Disclosure Agreement is governed by the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and the user agrees to comply with all provisions of HIPAA related to protected health information.
74. The user acknowledges and agrees that it has read and understands HIPAA, and agrees to use and disclose any protected health information only as permitted by HIPAA and the Non-Disclosure Agreement.
75. The user further acknowledges and agrees that Brisuntech is a "business associate" under HIPAA and the user is a "covered entity" under HIPAA.
76. The user agrees to indemnify and hold Brisuntech and its officers, directors, employees, agents, and affiliates harmless from any claim or demand arising out of or relating to the user's violation of HIPAA or the Non-Disclosure Agreement.
